Oracle Drags HP Enterprise to Court for Copyright Violation

Per a Bloomberg report, Oracle Corp. ORCL is suing Hewlett Packard Enterprise Company HPE for an unspecified amount for assisting third-party Terix Computer to “illegally sell software update for Solaris operating system.”

Per report, Oracle alleged that HP Enterprise knew that Terix was selling the software support without any authorization. Oracle requires customers to buy the software directly from it.

According to Oracle’s general counsel Dorian Daley, “Oracle obtained a judgment against Terix, and will continue to pursue companies like HP that misappropriate our software for their own financial gain.” Reportedly, last year, the company got nearly $60 million in compensation from Terix. It is now appealing to the court to stop HP Enterprise from distributing any of its software code.

However, there was no official word on the matter from HP Enterprise, which was formed after its parent company Hewlett Packard split into two separate entities — HP Inc. HPQ and HP Enterprise — in Nov 2015.

It’s not the first time that the two tech giants locked horns. Earlier, HP Enterprise had sued Oracle for not providing support to Intel’s INTC Itanium chips. The hearing for this case will commence this May.

Oracle’s shares were down 1.5% and HP Enterprise lost 0.3% value during yesterday’s trading.

At present, Oracle carries a Zacks Rank #3 (Hold), while HP Enterprise has a Zacks Rank #2 (Buy).
