Dow Wins Second Bayer Lawsuit

Dow AgroSciences LLC, a wholly-owned unit of The Dow Chemical Company (DOW), won a second lawsuit that involved its Enlist technology. A federal court dismissed a suit brought by Bayer CropScience which alleged that Dow’s Enlist E3 soybean seed infringed Bayer’s glyphosate tolerance patents.

The Court stated that it was unable to find evidence supporting Bayer’s arguments. With the decision, Dow will be able to sell Enlist E3 soybean seed. The court issued the decision five weeks after Dow won the first case filed by Bayer involving its Enlist 2,4-D tolerance technology.

Recently, Dow AgroSciences LLC, announced that it is advancing an insect resistant trait that will offer soybean growers greater ability to resist attacks from plant chewing insects. Once the soybean insect-resistant trait receives regulatory approvals, it will be stacked with the company’s innovative Enlist soybean traits for elite and high-yielding varieties. This will provide the required insect control along with tolerance to multiple herbicides for improved weed management and to allow the crops to maximize yield in a highly efficient and sustainable manner.
