NEW YORK, Sept. 15, 2011 /PRNewswire/ — Advance Polybag, Inc. and Superbag Operating, Ltd. supported Hilex Poly’s victory in the settlement with ChicoBag Company. Earlier this year, the two companies jointly filed a lawsuit with Hilex Poly to prevent ChicoBag from using misleading and deceptive information in its marketing of reusable bags. With Advance Polybag and Superbag’s encouragement and to simplify the proceeding, Hilex Poly took the lead in settling the lawsuit through a mutual agreement reached with ChicoBag this week. As part of a settlement, Hilex Poly received an undisclosed monetary sum.
Isaac Bazbaz, Director, Superbag Operating, Ltd., and Rex Varn, Executive Vice President, Advance Polybag, Inc., released the following joint statement:
“This settlement is a clear win for the plastic bag manufacturers and recyclers who brought this suit against ChicoBag for their repeated use of deceptive marketing materials. Among other dishonest practices, ChicoBag created an imitation EPA website to share false information.
“This settlement is also a victory for consumers and transparency in the marketplace. Going forward, we hope all consumers and policymakers will have the most accurate, sourced data to make informed choices about the best carry-out option for consumers and the environment.
“Our win in this case highlights one example of the use of misinformation to fuel a campaign against our industry. Our companies look forward to working with all stakeholders to encourage greater recycling in the most honest and open debate.”
