Starfire Systems Files Trademark Infringement Lawsuit to Protect Company’s Good Name

SCHENECTADY, N.Y., Aug. 1, 2011 /PRNewswire/ — Starfire Systems, Inc. (www.starfiresystems.com), a leader in the field of Polymer-to-Ceramic technology, announced today that it has filed a lawsuit in the United States District Court, Northern District of New York, against Extreme Environment Materials Solutions, LLC (EEMS) and its founders, Herbert Armstrong and Walter J. Sherwood.

The lawsuit was filed to cease trademark infringement efforts on the part of EEMS, and Armstrong and Sherwood, both of whom are former Starfire employees. Additionally, the lawsuit aims to prevent breach of contract by Armstrong and Sherwood, misappropriation of trade secrets, and unfair competition resulting from the wrongful use of Starfire’s specialized technology.

One of the actions outlined in the lawsuit is the creation of a deceptive website that uses the Starfire name prominently in the domain name and throughout the site. According to the complaint, the website inappropriately uses the Starfire name to lure the viewer onto the website before promoting defendants’ products. The suit describes how the fake website is just one of the defendants’ many inappropriate and illegal actions designed to undermine Starfire’s good name.

“For more than a decade, Starfire has developed and refined confidential and trade secret technologies to develop our products and support the growth in the Albany-region’s high-tech sector,” said David Devor, CEO of Starfire Systems. “It is unacceptable for anyone, let alone two former employees, to steal and use Starfire property and technology for their personal and financial gain. These actions threaten the reputation of our company and may confuse customers into thinking they are purchasing our genuine products.”

Starfire is headquartered in Schenectady, NY and employs 12 people including engineers, scientists and project managers.

Prior to filing this lawsuit, Starfire Systems sent a letter to EEMS urging them to cease and desist, and that failure to do so would result in legal action. EEMS willfully ignored the letter and has continued to use an internet domain name that infringes Starfire Systems’ registered trademarks.
